According to NBC NEWS, the Senate passed SB 52, which would stop drivers from text messaging behind the wheel.  The only person to vote against this bill was Republican Sen. Joe Negron of Stuart.

Our Orlando car accident lawyers understand the Senate also added an amendment that would make it okay for officers to use a drivers’ mobile phone records as evidence if texting causes a crash resulting in death or personal injury.

As it stands now, there are 39 states that have prohibited drivers from text messaging behind the wheel.  If plans go accordingly, Florida will be the 40th.

We talk often about the thousands of people who are killed in distracted driving car accidents each and every year.  According to distraction.gov, there were more than 3,330 people killed in these accidents in 2011.  But those are only the accidents of which we are aware.  Officials actually believe that this number is much higher.

“That’s why we’re working with states and law-enforcement agencies to add more precise categories to police reports,” NHTSA Administrator David Strickland.

The problem is that drivers aren’t likely to admit when it was distraction that caused an accident.  Unfortunately, witnesses are hard to come by, too.  And when there’s a fatality involved, the cause of an accident is even tougher to determine.

Officials with the National Safety Council (NSC) believe that we don’t hear about even a fraction of these accidents, meaning there are thousands more killed because of driver distraction.

The problem here is that we all know right from wrong.  But without the deterrent of a potential traffic citation, too many act counter to common sense.  With the new bill, hopefully drivers will think twice before putting lives at risk.

When using a cell phone in the driver’s seat, you’re nearly 5 times more likely to get into a car accident.  When you’re text messaging behind the wheel, you’re close to 25 times more likely to get into a serious accident.  Are those risks ever worth it?

That’s the message of this year’s Motorcycle Awareness Month.  And we’re going to be pushing this safety campaign for the entire month of May, along with transportation officials throughout the state and those with Ride Smart Florida.

“Florida’s mild climate and beautiful scenery make it very attractive for Florida residents to own a motorcycle. Those same characteristics make it a popular destination for many motorcycle-riders who visit our state each year,” said the Executive Director of the Florida Department of Highway Safety and Motor Vehicles (DHSMV) Julie Jones.

-Make sure you’ve always got your helmet on.  Helmets are your best defense against serious injury and death in the event of an accident.

-Ride responsibly, “Don’t Drink and Ride.”  This means that you should never get on your bike after consuming alcohol — in any amount.

-Make sure you can be seen out there.  Always ride with your headlights on and wear bright clothing to help ensure that motorists can see you.

-Always drive one step ahead of the traffic around you.  Most accidents involving multiple vehicles are the fault of the other drivers.

We further ask that drivers and other vehicles remember that motorcyclists have the same rights as cars and trucks.  Drivers paying extra attention when they see or hear a motorcycle may save a life.  It is important that motorists always make a visual check for motorcyclists by checking mirrors and blind spots before entering or leaving a lane of traffic.

But what about our young ones?

Did you know that bikes are associated with more childhood injuries than any other consumer product except automobiles? Sadly, child bicycling deaths increase close to 50 percent above the month average in the summer. With more than 25.5 million children riding bikes, we know there are too many of those kids riding without a helmet.

Head injuries are the most serious kinds of injury for bicyclists involved in accidents.  These injuries are also the most common cause of death for riders.  That’s why you should always remember your helmet.  A proper bicycle helmet can help t reduce the risk of a head injury in the event of an accident by close to 90 percent.

And don’t think you’re safe just because you’re near home or on a sidewalk.  Close to half of all bicycle accidents happen on a driveway or on a sidewalk.  Regardless of where you are, you’ve got to put your best pedal forward and pay attention to your surroundings 100 percent of the time.

For a safer ride, just tune in with The League of American Bicyclists:

-Make sure you’re always following the rules of the road.  You’re required to follow the same laws as motorists.

-Make yourself as visible as possible.  You want motorists to see you, not overlook you.  Wear bright-colored clothing and make sure your bicycle is equipped with reflectors and lights.  Making your presence known out there is half the battle.

-Ride predictably.  Always ride in a straight line.  Make eye contact with motorists.  Abide by the same traffic laws as motorists.  Follow lights, stop signs and other traffic signals.

-Anticipate problems.  Be cautious of the traffic around you and stay one step ahead of other travelers.  Be extra cautious at intersections.

-Make sure you’ve always got a helmet on.  Make sure that the helmet fits on top of your head, not tipped back or forward.
