What is it?
Doctors, nurses and other caregivers are required to follow certain standard
procedures in diagnosing and treating patients. If a doctor fails to meet that
standard of care, and a misdiagnosis or surgical error results in injury or
death to the patient, the caregiver can be held legally and financially liable.
What causes it?
Misdiagnosis and surgical errors can occur in the emergency room, during a
birth, a scheduled surgery, or in the doctor’s office either due to
carelessness, lack of training, exhaustion, or simple error.
Misdiagnosis - Your doctor may fail to test for breast, colon, prostrate, or
other cancer despite visible symptoms. In the emergency room, heart attacks or
meningitis sometimes go undiagnosed. A misdiagnosis of a medical condition could
result in an unnecessary surgery or failure to perform a necessary procedure in
a timely manner.
Surgical errors - Surgeries can result in a myriad of errors that can cause
injury or death, including:
• Failure to properly monitor vital signs
• Anesthesia overdose
• Improper surgical procedures
• Operating on the wrong body part
• Leaving sponges or instruments in body
• Sliced nerves or blood vessels due to scalpel slippage
Why Jacobs and Goodman?
Medical malpractice is a specialty of our firm. We have extensive experience
litigating malpractice cases involving misdiagnosis and surgical error. To
pursue the case, we work closely with medical experts and investigators to
identify where symptoms were ignored or misinterpreted, tests weren't run,
improper surgical procedures were used, and vital signs were not adequately
monitored. We subpoena medical records, charts, and interview staff in order to
gather eyewitness testimony to support your case and hold negligent doctors,
nurses, and radiologists liable for negligence that leads to injuries.
We know the other side. Many of our attorneys have worked for the defense side
early in their careers, defending hospitals and doctors, so we know how the
other side thinks, what tactics they’ll try, and what actions to take to counter
them.
We have the financial resources. Insurance companies have deep pockets, and they
spend that money to not only fight your claim, but to prolong the case with the
hope of breaking you financially. We have the financial resources to fight them,
and we’ll spend whatever is necessary to bring in the best experts and follow
the case to the end, without cutting corners.
We’re experienced trial lawyers. We approach each case as though we’re going to
trial. While many of our cases settle out of court with satisfactory
remuneration for the client, it’s only because the defense knows we can take it
to trial effectively.
